Terms & Conditions
General
These terms and conditions apply to all sales by SunChoice to the exclusion of all others and apply unless otherwise agreed in writing by a properly authorised representative of Sunchoice.
Ordering and Delivery
Orders placed by 12.00 midday for stocked items, will be delivered within two working days (Saturday and Sunday and Public Holidays are not working days).
Orders in excess of £100 (ex. VAT) for stock items will be delivered free of charge.
Postage and Packing will be charged on all other orders at a rate of £7.00 plus VAT. Next day deliveries or Saturday deliveries will incur Postage and Packing of £25.00 plus VAT.
Goods temporarily out of stock will be delivered to you on the next specified delivery day for your area after new stock arrives, unless otherwise agreed with your Account Manager.
Price
The price of goods is the price ruling at the date of dispatch. All prices quoted exclude VAT and carriage. Where special prices have been quoted in writing, any VAT and carriage will be payable in addition to the prices quoted.
Returns Policy
On delivery of goods you or your representative will be asked to sign for receipt of the consignment. You will need to check that the number of packages noted on the consignment documentation equals the number received.
Any discrepancies between those goods delivered and those ordered, and any damaged goods must be notified, to us, by 5pm on the day following the day of delivery. To do this please call our customer service line (01925 248 101) and speak to your Account Manager or leave a message with relevant details of the problem on our answer phone at weekends or out of office hours.
We regret that discrepancies notified to us outside this period cannot be rectified nor can a credit be given.
Missing or damaged goods will be replaced at full invoice price (carriage free) pending an investigation by us. Replacement goods supplied by us may be credited to your account following investigation.i. We expect this process to take about 7-10 days.
On completion of a damage report form (which will be faxed to you on receipt of your claim), your Account Manager will confirm the arrangements put in place to return the goods.
Cancellation of Order before Delivery of goods
If an order is cancelled within 48 hours of advised delivery date, a charge will be made to cover our costs and expenses incurred to that point.
Restocking of items not required
Items no longer required or which have been ordered in error may be accepted for return within seven days of delivery and in agreement with the operations manager. All items must be undamaged in their original containers, and in every respect unused and intact. Items can be returned, either at your expense or an uplift can be arranged through your Account Manager, which will be subject to an uplift charge of £30 plus VAT per consignment. A handling charge of 10% (or £5, which ever is the greater) is payable on each item returned.
Payment
On opening your account you will be notified in writing of your credit limit. In general this will be based on 2.25 times your average monthly purchasing requirements as agreed with your Account Manager.
Invoices will be issued on the day of despatch of the goods and must be paid within 30 days of the end of month in which the invoice was issued.
In the event of late payment Sunchoice shall be entitled to:
i) Suspend any further deliveries, and
ii) Charge interest on the amount unpaid at a rate of four percent above Natwest Bank base rate from time to time.
You are not entitled to offset any debt or claim against us to amounts owing to us.
Force Majeure
Where we are unable to deliver due to circumstances beyond our control we may suspend deliveries while those circumstances subsist and any agreed date
or period for delivery shall be regarded as extended accordingly. If any period of suspension of delivery lasts for more than one month, either party may cancel the contract by written notice without penalty.
Our Customer Service Department will inform customers if this comes into force.
Risks and Ownership
The risk in the goods passes to you when the goods are delivered to the delivery address. Ownership of the goods remains with SunChoice until payment has been received in full.
Insolvency
If:
(a) you make any voluntary arrangement with your creditors or become bankrupt or become subject to an administration order, or go into liquidation; or
(b) you cease, or threaten to cease, to carry on business; or
(c) SunChoice reasonably believes that any of the above events is about to occur and notifies you accordingly;
then you shall cease at once to use any goods not then paid for and shall, on demand, return, to SunChoice, any of them remaining in your possession. On making such a demand, we are entitled, without incurring any liability to you, to enter your premises and remove and repossess such of our goods as are found to be there, and also to cancel any contract with you.
Warranties and Liabilities
Where appropriate, SunChoice warrants that the goods will correspond with the specification and will be free from defects and from workmanship. This warrantee is subject to the following conditions:
(a) SunChoice shall not be liable: (i) in respect of any defect arising otherwise than from fair wear and tear, or arising from wilful damage, negligence, failure to follow care instructions, abnormal working conditions, misuse or alteration. (ii) If the total price of the goods has not been paid by the due date. (iii) If the defect arises from any drawing, design or specification supplied by the customer.
(b) Where goods are faulty, SunChoice shall be entitled to replace the goods free of charge, rectify the fault, or at SunChoice’s discretion refund the price of the goods, and SunChoice shall have no further liability.
(c) SunChoice shall not be liable for any loss or damage whether direct or consequential or otherwise but in any event SunChoice’s liability (if any) shall be limited to the price of the goods.
(d) Nothing in these terms affect SunChoice’s liability for death or personal injury resulting from SunChoice’s negligence.
(e) Nothing in these terms affects your statutory rights.
Replacement of Products
SunChoice reserves the right to alter specification of products from the catalogue at any time. On such occasions, customers will be advised upon order placement, and substitutes offered where applicable.
